Dispatch Authorization
Today, the role of the freight forwarder plays a crucial role in import and export operations, therefore, it is attractive to consider hiring a specialized service to facilitate these activities and promote business development. Obtaining clearance authorization is significantly expedited and made more efficient by the intermediation of a reliable customs representative.
What is a dispatch authorization?
The clearance authorization is a document by which an importer or exporter grants permission to a customs representative to present, on his or her behalf, one or more customs declarations.
This document allows the business to be represented in various situations related to customs, such as customs inspections, requests for improper entry, disputes over tariff classification, sanctioning processes and other customs procedures . This authorization can be specific for one occasion or global for multiple situations.
It is important to take into consideration the 2015 updates regarding customs clearance authorizations if the company is dedicated to import and export. Otherwise, the goods may be detained.
How to formalize the dispatch authorization?
There are four modalities to formalize the authorization of the customs representative according to the AEAT:
- Appearance in person of the customs representative, with the documentation signed by the businessman.
- Appearance in person of the businessman, to formalize the authorization and verify the correctness of the documentation.
- By power of attorney or authenticated signature, presenting the documents with a power of attorney or form signed by the businessman and validated by a notary.
- Through the Internet, using legal electronic signature procedures, for which a digital certificate is required.
Managing customs clearance authorization involves great bureaucratic complexity. Therefore, it is advisable to leave these procedures in the hands of experts who can streamline and make business customs procedures more efficient.
The presentation of any customs declaration with authorization implies its acceptance, including the acceptance of the receipt of requirements and communications. To do this, the official in charge must verify the content to proceed with the registration of the authorization.
In the case of authorizations by appearance, the identity of the appearing party and the content of the form must be verified. If defects are detected, they will be notified so that they can be corrected in a period of ten days.
Regarding online authorizations, only those that contain all the data requested in the form can be registered.
To proceed with the registration of a clearance authorization, complete data of the importer or exporter and the data of the representative who will act as customs representative are required, which include:
- Full name, name or company name, as well as the NIF of the principal.
- Full name, name or company name, in addition to the NIF of the authorized customs representative.
- Authorization type: global or per operation.
- Type of representation: direct, indirect or both.
- Territorial scope of the authorization, specifying whether it is national or for the customs areas where it is valid.
- Effective date of the power of attorney.
- Reference number of the registration and date of registration in the registry.
Is dispatch authorization necessary?
Indeed, obtaining a dispatch authorization is not mandatory, since the procedures can be carried out individually. However, hiring a third party to handle these responsibilities can significantly speed up the process. Both importers and exporters have the ability to personally make customs declarations and complete customs clearance procedures. However, this approach can be expensive and complex; Therefore, it is common to trust customs agents or freight forwarders.
Customs representatives, being Authorized Economic Operators, are usually subject to fewer documentary and physical controls on the merchandise, which reduces dispatch times. This is essential for companies, which seek to complete fewer procedures and receive their merchandise as quickly as possible and without complications.
In the event that the importer or exporter chooses to be represented at customs, customs clearance becomes essential.
There are two types of authorizations: per operation, which apply to a single management, and global, which allow the client to be represented in all operations and customs procedures, unless cancelled. Global authorizations are generally preferable due to their greater agility in dispatch.
Customs requires that the customs representative have in his possession the original clearance authorization document, duly signed, to carry out any operation. This requirement is crucial so that they can act on behalf of the corresponding company or client.
It is important to note that the dispatch authorization cannot be transmitted by fax or email, since the original document signed with a legitimate signature is required.
Having a customs representative greatly simplifies the international commercial management of companies, allowing them to be more competitive and expand to other markets. Although they could handle these tasks themselves, it is more beneficial to have a trusted agent.
In addition, having a customs representative allows companies to save resources and time by avoiding hiring additional staff for these tasks, allowing them to concentrate on their main activities. For these reasons, more and more companies are opting for this service.
To improve the competitiveness of a business, there is nothing better than expanding into new markets, which involves dealing with other countries and going through customs. In this sense, it is more effective to turn to professionals who can optimize customs processes, making operations more agile, simple and efficient.
Receiving a dispatch authorization is essential for companies of all sizes, since any type of business can benefit from entering a constantly changing market.
